The Policy & Workplace Relations (PWR) department is responsible for developing and delivering quality workplace relations advice, solutions, policies, processes and systems which are consistent and integrated with the business of the University.

The role and your responsibilities

The PWR Senior Advisor will proactively deliver ER support, and management of cases of all levels of risk cases across a range of ER issues including conduct, performance, change and inherent requirements. There is a strong emphasis on cutting through to the root cause of an issue whist assessing the bigger picture and then developing a suitable resolution strategy in partnership with the manager, senior manager and HR Business Partner. Resolution strategies will include a range of interventions including ADR, restorative justice, workplace investigations and disciplinary processes. The senior advisor may be required to conduct workplace investigations.

The Senior Advisor will also be required to represent the University in external jurisdictions such as the FWC and human rights commissions.

The senior advisor will provide advice and resolve enquiries regarding interpretation of enterprise agreements, policy and contracts of employment much of which comes via colleagues. Advice regarding change projects and associated ER implication is also an important requirement of the role. This position will also be expected to provide coaching and training for various stakeholders of the University as required as well as mentor and assist more junior members of the PWR team.

Skills and experience required

  • Base level knowledge of the Fair Work Act 2009 and contract law essential with the ability to become an expert in all RMIT University enterprise agreements and policies.
  • Demonstrated experience in case management of matters such as misconduct, underperformance and industrial disputes through to resolution.
  • Demonstrated experience providing advice/consultation on a broad range of workplace relations matters including performance management, misconduct, industrial disputes major change and terminations in large complex organisations.
  • Ability to review, interpret, and formulate professional responses to notices of dispute or complaint submitted by staff, the union or other paid agents which appropriately address the issue in question whilst managing risk to the University.
  • Ability to draft emails, letters, advice, simple submissions and complete any other memos/templates/documents at a standard expected of a senior workplace relations practitioner in a University environment.
  • Ability to effectively negotiate with and influence unions, clients and other senior stakeholders to achieve support and strategic outcomes.
  • Ability to research and respond to industrial questions with reference to industrial instruments, contracts and policy.
  • Ability to analyse and interpret data in order to generate and deliver information in a sensible and appropriate format.
  • Expert grasp of the fundamentals of procedural fairness/natural justice and how this manifests in a workplace investigation. Experience in conducting workplace investigations is essential.
  • Must hold and maintain a valid working with children check (or be able to pass a check)
  • Ability in the use of a range of computer applications, including Microsoft Office Programs. Ability to adapt to HR tools including ServiceNow, PageUp and SAP.
  • Advocacy of matters at FWC or other external jurisdictions is desirable.
  • Some experience with aspects of enterprise bargaining such as negotiating, drafting, and implementation
